1. The service

Aicmark provides upload of student homework and exam papers, AI marking and analysis, student performance records, local and international same-year comparisons, and report downloads. Available features may vary by account level.

AI comments and scores are for teaching reference only. They are not official exam results or professional assessments. Teachers must review all outputs themselves.

2. AI-generated suggestions and disclaimer

You acknowledge that:

Limitations of AI suggestions: comments, scores and analyses generated by AI (collectively, “Suggestions”) are produced automatically by machine learning. They may contain errors, omissions or bias and cannot fully understand cultural context or linguistic complexity.

Use at your own risk: you agree that you bear all risks from evaluating and using any Suggestions, and that any reliance on their accuracy, completeness or usefulness is your responsibility.

Not professional advice: outputs from this service must not replace professional educational assessment or legal advice.

3. Accounts and eligibility

You must provide accurate registration details and keep your password secure. You are responsible for all activity under your account.

If you register on behalf of a school, you warrant that you are authorised and will comply with school policies and the Personal Data (Privacy) Ordinance.

If you discover any unauthorised use of your account, you must notify us immediately and provide reasonable assistance when we request it to prevent or stop such use.

4. Use of student data

You agree that:

Uploaded homework, papers and related content may be processed by AI. Analysis results are retained in our system as student records and as part of the service database.

Where system settings allow, eligible assessment results may be included in an anonymised same-year / same-age comparison database to provide level benchmarks. You may opt out of that shared database and of AI training use as described in the Privacy Policy.

Original upload files are not kept long-term. See the Privacy Policy for details.

5. Acceptable use and prohibited activities

You may use the service only for lawful educational assessment. In addition to illegal or infringing content, you must not:

Attempt to reverse engineer, decompile, decode or otherwise obtain the source code of the service.

Copy or modify the service, or create derivative works based on it.

Use the service or any Suggestions to develop or train any AI model that competes with the service.

Conduct security scanning, vulnerability probing or penetration testing against the service.

Systematically scrape, harvest or extract data from the service.

You warrant that you own or are licensed to upload the relevant files.

6. Intellectual property

Your rights: you retain existing rights in student work content that you upload.

Our rights: intellectual property in the service interface, trademarks, software and original content belongs to us or our licensors.

Rights in AI-generated content: copyright and related intellectual property in Suggestions generated by the service (including comments, scores and reports) belong to us. We grant you a non-exclusive, non-transferable right to use those Suggestions within the scope of the service.

7. Changes and termination of the service

Changes to the service: we may modify, suspend or terminate the service (or any part of it) at any time, for example to update features, adjust system architecture or change service models.

Notice and effect: we will use reasonable efforts to notify you of material changes via website notice or email before they take effect, on the date specified in the notice.

Termination by you: you may stop using the service and delete your account at any time.

Termination by us: if you materially breach these terms, threaten service security or operations, or where required by law, we may suspend or terminate your account and access immediately without prior notice.

Effect of termination: after your account is terminated you will no longer be able to access data in your account. We will handle your data in accordance with the Privacy Policy, but may retain certain records to comply with legal obligations or resolve disputes.

8. Quotas, plans and changes

Credit limits for Basic and Premium accounts are as published on the website. Credits are charged per AI use (not by token volume). We may reasonably adjust features, credit limits or pricing with advance notice where practical.

Third-party AI services may be delayed, inaccurate or unavailable. We do not guarantee perfectly accurate marks or uninterrupted service.

9. Disclaimer and limitation of liability

The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss.

10. Suspension and termination

We may suspend or terminate accounts if you breach these terms, misuse the service or where required by law. You may stop using the service at any time.

11. Governing law and dispute resolution

These terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes should first be resolved amicably; failing that, the courts of Hong Kong shall have exclusive jurisdiction.

12. Entire agreement

These Terms of Use constitute the entire agreement between you and us regarding the service and supersede all prior or contemporaneous oral or written communications.
