Privacy Policy

1. Who we are

Aicmark provides AI-assisted assessment of homework and exam papers, student performance records, local and international same-year comparisons, and related analysis tools for teachers. The service is primarily used by teachers and educational institutions in Hong Kong and other regions.

2. Information we collect

We collect only what is necessary to provide and improve the service, and we do so lawfully, fairly and transparently.

Account data: such as email, name, school name, account type, country or region preference and sign-in related information. On registration we may suggest a default country or region from your connection IP; you can change this after sign-in in Settings. We also send account verification and password-reset codes to your email.

Student personal data: student personal data provided by teacher users (such as name, year level and student code) and related assessment records (such as scores and comments). If a school enables “hide student names”, teachers and admins only see student codes in the app interface; names may still be stored so the school can restore display if the setting is turned off later, but are not shown to users at that school in the application.

Homework / paper and assessment data: the content of files you upload (for AI analysis), and learning data generated by the system, such as analysis results, scores, comments, error tags and comparison summaries.

Technical data: such as IP address, browser type, sign-in times and server logs, used for system security and troubleshooting.

3. Cookies and similar technologies

We use cookies and similar technologies to provide and improve the service. Cookies are small text files stored on your device.

Strictly necessary cookies: used to maintain your sign-in session, remember your language preference and record your cookie consent choice. These cookies are required for the service to work.

Non-essential cookies: we do not currently use analytics, advertising or social media cookies. If we introduce them in future, we will update this policy and enable them only with your consent.

You can manage or delete cookies through your browser settings; disabling necessary cookies may affect sign-in, language and other features. When you first visit the site, you can choose “Accept all cookies” or “Essential cookies only” via the banner at the bottom of the page.

4. How we use information (purposes and legal bases)

We use your data on the following lawful bases:

Contract and service delivery: to operate, maintain and improve assessment, reports, student files and account features (including regional and global same-year comparisons).

Legitimate interests: for same-year / same-age analysis, error-type statistics and service improvement (we prioritise de-identified or anonymised data where possible). Your students’ personal data will not be used for any purpose unrelated to teaching and assessment. If you or your school have opted out of the shared database (see section 11 below), we will not use related grading or import results for those aggregate analyses or for AI training / model improvement.

Legal obligations: to use or disclose data where required by law or necessary to protect this website and users’ rights.

5. AI processing and third parties (data processors)

To complete assessments, file content and necessary context may be transmitted to our AI service providers. We contractually require these providers (acting as our “data processors”) to meet security and confidentiality standards equivalent to this policy. Transmission needed for a single marking run is separate from including your data in future model training or a shared database; you may opt out of the latter under section 11.

Our website hosting, database and infrastructure are provided by cloud service providers. We likewise require them to take reasonable security measures.

6. International data transfers

Our service may involve cross-border data transfers (for example, for global student comparisons). When your data is transferred outside Hong Kong, we ensure safeguards that meet the requirements of the Hong Kong Personal Data (Privacy) Ordinance (such as standard contractual clauses) to protect your data.

7. Storage and retention

Account, student file and assessment records are stored on our servers. We retain data no longer than necessary for the purposes for which it was collected (for example, after an account is closed, related backup data will be deleted within a reasonable period such as six months), unless the law requires otherwise or retention is needed to exercise or defend legal rights.

8. Security

We use reasonable technical and organisational measures (such as HTTPS, access controls and password hashing) to protect data. Please understand that internet transmission and electronic storage cannot be guaranteed to be completely secure; please keep your account password safe.

9. Your rights and choices

You have the right to:

Sign in and manage your student files and assessment records.

Access, correct or delete personal data relating to you or your students.

To exercise these rights, to opt out of the shared database / AI training use, or if you have questions about data processing, contact us using your registered email: info@aicmark.com.

If you are not satisfied with how we handle a complaint, you may lodge a complaint with the Office of the Privacy Commissioner for Personal Data (PCPD) in Hong Kong.

10. Hiding student names (anonymisation)

School admins can enable “hide student names” for individual schools. When enabled:

Teachers at that school only see student codes (not names) when selecting students, viewing student files or using marking interfaces.

Admins managing that school’s students in the console also do not see names—only codes, year level, school and other non-name data.

This helps schools use AI assessment while protecting student privacy; marking still works and regional and global same-year comparisons continue.

Names may remain stored so the school can restore display if the setting is turned off later; we do not show hidden names to users at that school in the application.

11. Opting out of the shared database and AI training

You may choose that grading or imported data is not included in our shared / comparison database used for aggregate analysis, and is not used for AI training or model improvement.

When enabled: related grading and import results remain stored in your account and student files for teaching, history and service operation, but are not included in the anonymised same-year / same-age comparison database and are not used to train or improve our AI models.

You may request this by emailing us from your registered address, or our site administrators may enable it in the console for a school or an individual user. A school-level setting applies to all teacher accounts at that school; a user-level setting applies to that user.

When a single AI marking run is performed, file content may still be transmitted to AI providers as described in section 5 to produce that result; that is distinct from including data in future training or a shared database.

12. Children and student data

Student-related data on this service is managed through teacher or school accounts. Teachers and schools must ensure that:

Explicit consent has been obtained from a student’s parent or guardian before using the service to collect and process that child’s personal data.

This policy has been provided to the relevant parties.

13. Changes to this policy

We may update this policy from time to time and will show the update date on this page. For material changes we will notify you on the website or by email. Continued use of the service means you accept the updated policy.
